Overall it looks like the potential changes identified by Art 138 (1 – 3) may be progressively introduced anyway as EU REACH changes. The concept of Substances of Concern is being looked at in EU REACH / CLP change proposals. it is looking like so far attempts are being made to align EU and UK regulation.
